Terms of Use
Agreement between User, PURCHASER, and SARAH C. NIGHTINGALE ART. Please read all “Terms of Use”.
Sarah C. Nightingale Art is a service offering fine art paintings, prints, reproductions, and commissioned paintings. All artwork, images, and graphics are the sole property of Sarah C. Nightingale and may not be used by any third party without written permission.
Sarah C. Nightingale Art retains all master and reproduction rights to all artwork created and included on SarahNightingaleArt.com; even those of sold, commissioned, and original paintings. The purchase of a product does not provide the purchaser with any copyright interest or intellectual property rights in the product.
The purchaser may not reproduce the artwork in any way without written permission from Sarah C. Nightingale Art. Any image or reproduction of artwork by Sarah C. Nightingale Art in a 3d party publication (including but not limited to: SOCIAL MEDIA, MAGAZINE, BOOK, ETC.) without consent is strictly prohibited. Third party publication must contain attribution to Sarah. C. Nightingale Art (Artwork Title, Artist’s Name) in all publications.
The purchaser, private or public collector, has the right to display the artwork in your home or business. The artwork may not be resold or reproduced in any way or for profit without written permission from Sarah C. Nightingale Art. All other uses must be agreed upon in writing.
If you are interested in purchasing full or partial rights for reproduction purposes, please email SarahNightingaleArt@gmail.com. Sarah C. Nightingale Art retains all reproduction rights unless purchased in addition to purchasing original art.
Cancellation/Refund Policy
Fine art prints and non-original products: You may cancel your order within the first 24 hours. After 24 hours a 15% restocking fee will be applied. Returns and exchanges are handled on a case by case basis and at the sole discretion of Sarah C. Nightingale Art. Sarah C. Nightingale Art is not to be held liable for any mishandling or failed delivery by the shipping service (USPS or UPS). Please contact SarahNightingaleArt@gmail.com within 7 days of receiving your artwork if there are any problems. (It is rare, but sometimes damages occur in shipment. On a case-by-case basis, a replacement for damaged fine art prints or non-original products can be sent with proof of packaging damage and damage to the product.)
Original Paintings: All sales of original artwork are final. Orders canceled before shipment will incur a 20% restocking / re-marketing fee. Returns or exchanges of original work are not available.
Sarah C. Nightingale Art reserves the right to change Terms and Use under which SatahNightingaleArt@gmail.com is offered. The most current version of the Terms and Use supersedes all previous versions. Please read and review current Terms and use carefully.
